Illinois Lactation Room Requirements

Under 820 ILCS 260, employers (with more than five employees) must:

Provide reasonable break time each time an employee needs to express milk, for up to one year post-birth; this time may run concurrently with other breaks and must not reduce pay.

Offer a private location other than a restroom, close to the work area, for pumping in privacy.

Ensure the break time is paid, not unpaid, as clarified in amendments.

Maintain consistency with the Illinois Human Rights Act, requiring employers to demonstrate "undue hardship" before granting exemptions—this must meet a high threshold.
